In 2004, he was found guilty of the first-degree murder of his pregnant wife, Laci, who had been killed in 2002, and of the second-degree murder of their unborn son, Conner, who had also been killed in 2002. Both crimes took place in Modesto, California.

After being found guilty, Peterson was given a sentence of execution by injection of deadly drugs. His case was immediately appealed to the state's highest court, the Supreme Court of California. The sentence of death that had been imposed on Peterson was overturned, but his conviction remained unchanged. He was re-convicted and given a new sentence of life in prison without the chance of release.
